What is the start-up initiative of government of India?

The ongoing initiative of start-up India was launched by the government of India in Jan 2016.The object was to boost start up culture and create an environment of Entrepreneurship in India. Start-up India is a flagship initiative of the government of India, intended to build a strong ecosystem for Nurturing innovation and start up in country that will drive sustainable economic growth and generate large scale employment opportunities. The government through this initiative aims to empower start up to grow through innovation and designee.

*India is the Third largest start up hub in the world. About 31945 start up under the start-up India initiative recognised by DPITT to date

What is the objective of Start-up initiative?

The start-up India initiative has rolled out several programs with the objective of supporting entrepreneurs, building a robust start-up ecosystem and transforming India to in a country of job creators instead of job seekers. These programs are managed by a dedicated start-up India team, which reports to the Department for promotion of industry and internal Trade (DPIIT).

Which type of entities are eligible for start-up Registration?

An entity is required to satisfied the following condition for Start-up Registration

  1. It should be a Private Limited Company or registered as partnership Firm or Limited Liability Partnership,
  2. Its Turnover should be less than Rs. 100 crore in the previous financial years
  3. An entity shall be considered as start-up up to 10 years from the date of its incorporation
  4. The entity should be working towards innovation, improvements of existing products, services and should have the potential to generate employment/ create wealth.
  5. An entity formed by splitting up or reconstruction of and existing business shall not be considered a start-up.

What is the objective to recognise an entity as start-up?

The objective of star-up recognition is to reduce the regulatory burden on start-up, thereby allowing them to focus on their core business, keep compliance cost low and provide various benefits

What are the benefits available to an entity after recognition as start-up?

Following benefits allowed an entity after recognition as Start-up

  1. Self-Certification: Start-up shall be allowed to be self-certify compliance of SIX labour laws and three environmental laws through a simple one line procedure.
  2. Fast Tracking of Stat-up patent application:- Patent application filed by start-up shall be fast- tracked for examination so that their value can be realised sooner. Start-up shall be provided an 80% rebate in filling of patent vis-v-vis other Companies
  3. Income tax Benefits:
    1. Eligible Start-up can be exempted from paying income Tax for Three consecutive Financial Years out of their first 10 years since incorporation
    2. Exemption under section 56(2)(VIIB) of Income Tax
  4. Easy winding-up Procedure:-  As per the insolvency and Bankruptcy code 2016, Start-up with simple debt structure or those meeting certain income specified criteria can be wound up within 90 days of filling of an application for insolvency.
  5. Easier Public Procurements Norms:-  Government E-market Place (GEM) is an online procurement platform and the largest market place for government Department to procure product and services. DPIIT recognised start-up can register on GEM as seller and sell their product and services directly to government entities. This is a great opportunity for Start-up to work on trial order with government. There are also certain benefit to start-up under Easier public procurements Norms.

What is the procedure of Start-up registration?

An entity want to registered itself as start-up is required to make on line application to Department for promotion of industry and internal Trade (DPIIT) through the National single window system (NSWS) along with the prescribed documents.

What are the documents required for Start-up registration?

Following documents are required for Start-u registration

  1. A certification of incorporation or registration ,as the case may be
  2. Pan No. of Entity
  3. Pan and Aadhar No. of Authorise representative
  4. Email Id and Mobile No of Authorise representative
  5. Emil id and Mobile No. of Entity
  6. A write-up about the nature of business.
  7. Other documents
