What is the Legal Metrology (packaged commodities) Rules?

Legal Metrology Packaged commodities Rules regulate the packaging requirement Of pre- packed Commodities which shall be sold, delivered or distributed Within the country. This rule has been introduced by the central government in order to ensure & protect the right of consumers who are using pre-packed commodities .The central government has made mandatory requirement that certain disclosure required to be made by manufacturer, Packer and importers on pre-packed products or commodities. These details includes such as

Who is the packer?

Any person or Firm, which pre-packs any commodity in bottle, tin, wrapped or otherwise in units suitable for sale is a packer.

What are the pre- Packed Commodities?

Pre- Packed products means a product which without the purchaser being present is placed /packed in a packages of whatever nature, sealed or not, so that product contain therein has a pre-determined quantity.

Whether is there any requirement under LMPC Rules for persons who are dealing in pre-packed commodities?

Persons who are selling, delivering or distributing any pre-packed commodity is required to get packer registration (certificate/licence ) as per legal metrology packed commodities Rules 2011 otherwise their product may be seized by the government department and they will have to pay heavy fine.

Who are required to get this packer registration?

As per LMPC Rules Manufacturer, Packer and importer who want to sell, delivered or distribute a pre-packed commodities is required to get a packer Registration within 90 days from the date of commencement of pre-packaging.

Partnerships Deed (in case of partnership)

Monogram/ Trademark

Land Conversion Certificate

Food license for food item

Liquor License

What is the validity of LMPC Packer certificate?

This certificate is issued by legal metrology department of central government and it is valid for life time of the product in respect of which this certificate has been granted. However if the area of operation of an entity is limited within a state then same certificate shall be issued by legal metrology department of respective state government.

What are the item on which legal metrology (packaged commodities) Rules 2011 are not applicable?

Following are the items on which the Packed commodities Rules 2011 Not applicable

Any Raw material for industrial purpose only
Fast food item packed by restaurant/ hotels & like
Drug /Medicine covered under drug control order 1955
Cement, fertilizer & agriculture farm produced sold in bags above 50kg

What will be the consequence if a Person do not get this certificate/ Licence?

Rule 32 of Legal Metrology (packaged Commodities) Rule provides that, whoever contravenes any of the provision of these Rules shall be punishable with fine, as may be prescribed.
