What is the meaning of Model as per Legal Metrology Act?

Model means the final physical representation of a weight or measure in which all the components imparting to it the necessary metrological and technical characteristics and qualities as provided in the Act and the rules made thereunder are suitably assembled so that subject to prescribed tolerances, every weight or measure produced in accordance with such model may be similar as regards dimensions, construction. Material performance and other metrological and technical characteristics.

Who is required to get the model approval?

Every person who is the Manufacturer or Importer of any weight, measure or measuring instrument is required to get the model approval of such weight, measure or measuring instrument before manufacturing or importing it.

Which authority grant model approval under legal metrology Act?

Certificate of approval of model of weight or measure is granted by central government under section 22 of legal Metrology Act 2009

What is Model approval as per legal Metrology Act?

In accordance with the provision of section 22 of legal metrology Act, Every Person who is manufacturer or importer of any weight, Measure or   measurement instrument, shall seek the approval of model of such weight, Measure or measurement instrument from legal metrology Department of consumer affairs before manufacturing or importing it.

Under the model approval procedure a piece of weight, measure, weighing or measuring instrument is send for testing to notified testing laboratory to ascertain whether it conforms to the standards established by or under the Act and the rules made thereunder, finding out the ability of such model to maintain accuracy and other metrological characteristics and qualities after it has been put to use for such minimum number of times or over such minimum period and determine the performance of such model under varied condition of use.

Every Model has different technical specification that need to be approved by the notified testing laboratory under legal metrology (Approval of model) Rules 2011 both for mechanical and digital.

What is the procedure of model approval?

An application for the approval of model shall be made to the director of legal metrology department and such application shall contain

  1. The full Name and address of the applicant or where the model is manufactured from other countries ,the name and address of the manufacturer as well as the dealer in India
  2. A brief description of the weight or measure the class to which it belongs and the probable uses for which the weight or measure is intended to be produced
  3. Data regarding metrological and technical characteristics and qualities of the weight or measure
  4. Test procedure followed by the manufacturer
  5. Trade Name or brand name and type of the weight or measure
  6. The requisite fee specified in rule and ,
  7. Along with document as mentioned in point 5 above

 Note: – Second proviso of section 22 of Legal metrology Act 2009 provides that in case of import of any weight, measure or weighing or measuring instrument, if Director of legal metrology is satisfied that the model of any weight, measure or weighing instrument which has been approved in a country outside India conforms to the standard established by or under this Act, Director may approve such model without any test or after such test as he may deem fit.

i.e. Model can be approved in case of import without any test of model if director  is satisfied that model has already been  approved outside India and meet the standard as specified under this act and rules made there under.

What are the cases in which model approval is not required?

Model approval is not required in respect of any Cast iron, brass, bullion, or cart weight or any beam scale, length measures (not being measuring tapes) which are ordinarily used in retail trade for measuring textiles or timber, capacity measures not exceeding twenty litres in capacity, which are ordinarily used in retail trade for measuring kerosene, milk or potable liquors.

It has also been prescribed that if prescribed authority is satisfied that the model of any weight or measure which has been approved in a country outside India conforms to the standards established by or under this Act, approve such model without any test or after such test as he may deem fit.

What is the prescribed fee for testing of model for model approval?

As per Rule 19(1)  of Legal metrology (Approval of Models) Rules 2011 following fee has been prescribed for testing of Model for  Model for model approval

  1. 10000 for testing of mechanical type model of weights or measures or weighing and measuring instruments.
  2. Rs. 25000 for testing of digital or electronic type model of weight or measure or weighing and measuring instruments.

What would be consequence if a person do not take model approval?

There could be two consequence if a person fails to get the model approval

  1. As per section 32 of Legal Metrology Act 2009,Whoever fails or omits to submit model of any weight or measure for approval shall be punishable with fine which may extend to Rs. 25000 and for the second or subsequent offence, with imprisonment for a term which may extend to one year and also with fine
  2. Rule 20 of Legal metrology ( approval of Model) Rules 2011 provides that, State government shall satisfied itself that a certificate of approval of the model has been granted by central government before issuing a licence to manufacturing or importing any weight or measure.

 I.e. State government will not issue licence for manufacturing or importing any weight or  measure without model approval.
