At the time of import, aluminium products falling under the relevant Quality Control Order may be subject to verification by Customs authorities who may insist on the production of a valid BIS license or registration, as applicable. In case the required BIS certification is not available, the consignment may be withheld from clearance, which could lead to delays, storage/demurrage charges, and exposure to applicable penalties under law.
That said, there may be instances where certain aluminium products, including specialised tubes, do not conform to the chemical or mechanical parameters prescribed under the notified Indian Standards. In such situations, the importer has the option to seek clarification from the Department for Promotion of Industry and Internal Trade (DPIIT).
For this purpose, an application is required to be submitted to DPIIT along with a detailed technical submission establishing that the product in question falls outside the scope of the notified Quality Control Order. The application is examined on technical merits, and where necessary, DPIIT consults the Bureau of Indian Standards (BIS) before arriving at a decision.
If the authorities are satisfied with the justification provided, a No Objection Certificate (NOC) may be granted, allowing the import of the specified product. Such approval is typically issued with a defined validity period, generally up to six months from the date of issuance, and can be utilised for the import of consignments covered within its scope during that period
